Welcome to Easy Grow, our mobile gardening application available on iOS and Android platforms worldwide (the "App" or "Service").

These Terms and Conditions ("Terms") govern your access to and use of the App and its features, including plant identification, plant mapping, weather data, and gardening advice. All information and results provided are for informational purposes only and may be inaccurate.

The App is operated by the Easy Grow team ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not access or use the App.

1. Eligibility and Age Restriction

You must be at least 13 years old to use the App. If you are under 18, you may only use the App with the involvement and consent of a parent or legal guardian.

2. User Accounts

When you create an account, you agree to:

• Provide accurate, complete, and current information at all times
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use or security breach

You may not use as a username any name that is offensive, vulgar, obscene, or infringes on the rights of others.

3. User-Generated Content

The App allows you to upload, store, and share content such as plant photos, placements, notes, and other materials ("Content"). You are solely responsible for your Content, including its legality, reliability, and appropriateness.

By uploading Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, modify, display, reproduce, and distribute it for the purpose of operating, providing, and improving the App.

License for AI Training and Service Improvement

By uploading plant photos, you specifically grant us a worldwide, non-exclusive, royalty-free license to use them for training and improving our AI models and App functionality. This license applies to photos already used for these purposes and may continue indefinitely to ensure long-term accuracy and improvement.

You represent and warrant that your Content does not violate any third-party rights and complies with these Terms.

4. Prohibited Conduct

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Upload viruses, malicious code, or harmful content
• Scrape, reverse engineer, or interfere with the App
• Harass others or misuse features (e.g., map placements)
• Post false, misleading, threatening, defamatory, obscene, or otherwise objectionable content
• Infringe intellectual property or privacy rights of others

Violation of these rules may result in immediate termination of your account.

5. Advertisements and Third-Party Services

The App integrates Google AdMob for advertising, Google Firebase for storage and analytics, and Google Gemini for plant identification and AI processing. These services are subject to their respective terms and privacy policies.

6. Disclaimers and Limitation of Liability

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.

We do not warrant that the App will be uninterrupted, error-free, secure, or that results (including plant identification, weather data, or advice) will be accurate or meet your requirements. Do not rely on the App for safety-critical or professional decisions.

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if advised of the possibility of such damages.

AI-Generated Advice Disclaimer

The App uses Google Gemini to provide real-time gardening advice based on your plant information and local weather.

• Accuracy: AI-generated content is experimental and may be inaccurate or misleading.
• No Liability: We do not store your chats, but we also do not guarantee the results they produce. We are not responsible for any plant loss, property damage, or incorrect use of gardening products (like fertilizers or pesticides) based on AI suggestions.
• Professional Advice: Always verify AI suggestions with a professional gardener or local nursery before taking action.

7. Termination

We may suspend or terminate your access to the App at any time, without notice, for any reason, including breach of these Terms. Upon termination, your right to use the App ceases immediately. Licenses granted for AI training and improvement survive termination.

You may stop using the App at any time.

8. Intellectual Property

All App content, features, and technology (excluding your Content) are owned by us or our licensors and protected by intellectual property laws.

9. Governing Law

These Terms are governed by the laws of Poland, without regard to conflict of law principles.

10. Changes to These Terms

We may update these Terms at any time. Material changes will be notified in-app or via email where possible. Continued use of the App after changes constitutes acceptance of the new Terms.
